TDS Legislation

A detailed inventory has always been required, however with changes in legislation the spotlight is now firmly on the inventory, check in and check out process. Recent tenancy deposit scheme disputes have highlighted the need for a clear and concise inventory to protect the landlord and tenant. Many cases have resulted in a full return of the deposit as the landlord could not provide sufficient evidence to successfully pursue a claim.

A Charles J Harrison Inventory will include:

  • Detailed photography

  • Fixtures, Fittings and Contents

  • Descriptions, Condition and Damage

  • Meter Readings

  • Property Overview Descriptions

Completion

The importance of a properly completed inventory cannot be underestimated. It must be robust and defensible if it is to be held up as a proper indicator of the facts and therefore viewed as acceptable by an adjudicator or court. Tenancy deposit protection schemes do not disregard, out of hand, inventories that are not prepared by independent companies or individuals. However, they are likely to place less weight on their contents.

Any inventory document written by the landlord (not an independent third party) that doesn’t give details about the condition or age of an item will have less value when being considered by the adjudicator. It may also affect the landlord’s claim based on ‘a balance of probabilities'.

The Check-Out is a snapshot of the property at tenancy end. The report details the changes that have occurred during the course of the tenancy.

Check-Out Report

The Check-Out is a snapshot of the property at tenancy end. The report details the changes that have occurred during the course of the tenancy.

We do not require tenants to be present at the Check-Out but if requested they can be. Our clerks will use the original inventory, check-in, tenant amendments and any other relevant information while preparing the Check-Out.

Deductions

Financial decisions relating to deductions will never be made by a Charles J Harrison Clerk. Only the Letting Agency/Landlord will have the full history of the property and be able to correctly determine depreciation and fair wear and tear. If requested, we will attempt to determine ‘Recommended Responsibility’ for changes that have occurred to the property. These recommendations will take into consideration the current state of the property, the original inventory, check- in, amendments and any other supporting documentation provided to us prior to the Check-Out. However, because we will not have the full history of the property, ultimately the final decision will be made by the Managing Agent and/or the Landlord.

Booking

A Check-Out should be produced as close to the end of tenancy as possible. We encourage our clients to schedule Charles J Harrison to be the first contractor to enter the property after the tenant has vacated. This is always best to be the day after the tenancy end date.

Our Check-Out report will include:

  • Changes to the property

  • Meter readings recorded

  • Extensive Photography

  • Keys recorded

MID TERM VISIT

The Charles J Harrison Mid Term is a periodic visit where we check the condition during the tenancy, giving you feedback on how the property is being cared for along with any maintenance issues.

Our mid term visit report will include:

General tenant upkeep of the property 

Observations in relation to terms of the lease (smoking, sub-letting etc)

  • Significant damage

  • Room overview photography

  • Tenant comments (If present)

Completion

CHECK-IN

SERVICE

The Check-In is designed to provide the tenant with an

understanding of the inventory as well as allow an 

opportunity  for amendments to be made to the

inventory report.

The Check-In is designed to provide the tenant with an understanding of the Inventory as well as allow an opportunity for amendments to be made to the Inventory Report.

A Check-In appointment ensures the tenant had every opportunity to query, amend or discuss discrepancies at tenancy start. Tenancy Deposit Schemes are encouraging Landlords and Agencies to include a Check-In as part of the Tenant Entry process.

Our Check-In service will include:

  • Exemplify damage, cleanliness and condition

  • Make amendments with the tenant on-site

  • Agree meter readings

  • Record and handover property keys

  • Record tenant comments

  • Report electronic signature
